post October 1 2018. Please let me know how that is progressing as I am aware that the porter agreed to vacate the flat as part of his settlement . Once the flat is vacant the surrender from the management company to the freeholder can proceed with a view

will have to enter into a deed of variation to remove the restriction on use. This is a simple one/two page document.</span><o:p></o:p></li><li class="xmsolistparagraph" style="margin-top:0cm;margin-bottom:0cm;margin-bottom:.0001pt;mso-list:l0 level1 lfo1">
<span style="color:#0042AA">The management company and the freeholder company can agree a surrender of the lease- this would mean the title reverts to the freeholder company. The freeholder company would then be free to either (i) grant a new lease to the management
company without the restriction; (ii) sell the lease to a willing buyer- this would raise significant funds for the freeholder; or (iii) the freeholder company finds a tenant to rent the property to on an assured shorthold basis.</span><o:p></o:p></li></ol>

2018, the position of in residence porter is redundant. Therefore by that date, the porter is not anymore employed by the company and should vacate the apartment.<o:p></o:p></span></p>
