Good Morning Everyone,
I am now up to speed on matters having been out of the office on leave on Friday.
I have also been contacted by Adrian Norin’s solicitor this morning regarding the reference and hoping for the matter to be resolved today so that Mr Norin can leave the property.
I note in particular your emails Crispin and it appears you have simply stated what is fact. As it stands Adrian (not his girlfriend) were living in the property as a result of his employment, it was tied to his employment hence why it was a Service Occupancy and hence why when his employment comes to an end, he has to vacate the property. He was not a tenant in the normal sense of the word. The Service Occupancy agreement in place is very clear and is also echoed in the settlement agreement.
Crispin, please can you send me a copy of the reference you have provided so that I can review it and advise on next steps.
Kind regards
Nkolika

Good morning all!
Thanks Glenn for your email.
Just to clarify:
Mr. Norin salary is 22K. He gets this from the OWGM.
He is also living on the premises. From today in breach of his redundancy agreement.
The rental contract of the apartment where he lives is stipulated between the OWGManagement and the OWGFreehold, not between Mr. Norin and the OWGM.
Therefore, we are talking of a private agreement between two companies. The agreement’s terms have changed in time and are subject to constant revision.
Regarding Mr. Norin references, the managing agent or the OWGM directors cannot specify the terms of a private contract not related to his employment. For this, they need also the agreement from the Freehold company.
If Mr. Norin does not agree on the references provided since now on he should contact our lawyers.
As already mentioned, at this stage the matter is in their hands and not on the goodwill of the directors or the managing agent.
If we keep interfering with the lawyers work, apart than wasting time and money, we are also getting the feeling that some directors are trying to help Mr. Norin while other directors (or the managing agent) are acting as “bad cops”. Everyone is free to invest his time as he wishes, but for everyone else, it would be simply unfair to have to invest more time in this case after all the work done in these last months and a valid settlement signed from both parties.
Hopefully, this clarifies the situation.
Regards

Hi Crispin,
Thanks for your email.
Is Adrian asking for a reference which says that he is earning £49k plus flat and costs or £49k equivalent salary, which would be approximately correct if we include £22k and a normal rent for his flat plus bills?
Cheers,
Glenn.

Evening all,
The company is OWG and the reference requests came by email to me. Adrian had emailed asking me to state his salary as £49k per annum which is untrue.
His salary is £22k per annum and living at flat 39 he pays no rent.
His girlfriends’ reference stated that she occupies flat 39 on licence (as against being a tenant) and also pays no rent.
They also don’t pay bills - council tax and utilities.
The references were accurate and truthful.
I bear Adrian no ill will - just told it how it is.
Crispin.

Hi Team,
It will be a hassle, of course, if Adrian does not vacate Flat 39 by the end of today.
However, I would suggest that we just stay calm and follow the appropriate procedure which, of course, is to refer the problem to our lawyers Rradar.
I presume that they will start an eviction process.
I understand from Anna that Adrian’s girlfriend approached her and claimed that suitable references were not provided so that Adrian could secure alternative work and accommodation. If Adrian (or his girlfriend) have objections regarding anything that has not been done regarding his Settlement Agreement I think we can only ask him to put it in writing, perhaps through his lawyer as that should ensure that unreasonable objections will be filtered out. And we can either address the complaint if valid or just pass it to our lawyers.
I have looked through the Settlement Agreement and it says that “the Company” will provide references within a narrow framework defined by an addendum so it should be clear what he can expect. I presume “the Company” is WB19.
Cheers,
Glenn.
