Wow, Team!
Three days out of email contact and you have all achieved masses while I was away and I totally agree with how you have proceeded. One thing occurred to me. We picked up the bill for all the utilities and council tax.
Just in case this does not resolve rapidly, what is our legal position with regard to gas and electricity and also the council tax? Were these paid as part of his salary or as part of the residency? Should we get the meters read and notify him that he will be responsible for these while he sits there?
I hope I didn’t miss anything, as I confess, I did read all the mails quite rapidly this morning, after I turned the computer on.
We can always photograph the meters and send it to whichever provider we use and ask them to register the reading against the date.
Kindest Regards,
Yvonne

It is hoped that Mr Norin will now comply with the deadline set, however I have in any event put my colleague on notice the same and your instructions. She will be in contact with you in due course to discuss the potential next steps.

This Message contains suspicious characteristics and has originated outside your organization.
_____
Good evening Nkolika,
First of all, we would like to thank you and Mr. Sampson Bancroft for stepping in this afternoon and helping in fulfilling a very short notice deadline.
Following the email sent to Mr.Norin lawyer this afternoon (see in blue below):
Good Morning Nick,
I have taken further instructions from my client on this matter and they have instructed me to provide a further amended landlord reference attached.
My client, whilst appreciating the difficult position that Mr Norin and his family are in, cannot make statements that are not true. Mr Norin lived in the flat as a Service Occupier under a Service Occupancy agreement, neither he nor his girlfriend or her children were Service Tenants.
Although Mr Norin was a good employee, the same cannot necessarily be said for him as a resident of the flat. As I understand it from my client there were a number of issues, to name a few – removing the CCTV monitors without permission, moving his girlfriend and her children in without permission and discussion, instructing for an extra wall to be built in the bedroom without permission and discussion. That being said, they do not wish to go back and forth over old ground and believe that the attached is a compromise and still in keeping with the Settlement Agreement. They are not prepared to discuss any further changes to the landlord reference.
Mr Norin had reasonable notice on which to find an alternative place to live. He was given additional time and money to further help his efforts with this. As it currently stands he is a deemed to be a trespasser and is also in breach of the Settlement Agreement. I am instructed that if Mr Norin and his family have not vacated the property as agreed by the end of today or at the latest 12 noon tomorrow, this will impact on the payment to paid under the Settlement Agreement and my client will start the formal eviction process.
Kind regards
The OWGM wishes Mr. Norin to be successful in his today`s rental application.
In the past months, the Board also did all it could be done in order to facilitate Mr. Norin’s transition, including stopping the eviction process that according to a mutual agreement between him and the OWGM Company should have started on Monday 1st October 2018.
Unfortunately, some of the leaseholders/shareholders started to inquire why Mr. Norin is still living on the premises belonging to the OWG Freehold shareholders. This is obviously a very sensitive situation for the OWG Management Board.
The OWG Management and Freehold Directors have a duty to fulfil towards their shareholders, therefore are obliged to ask you to start without any further delay the formal eviction process in case the apartment 39 at 1 Warrington Gardens W9 2QB is not vacated by 12 noon tomorrow.
The board is not willing to take into consideration any kind of voluntary procrastination that could lead to further delays in vacating the premises, damaging further the shareholders interests.
Needless to say, whatever will be the case, we will appreciate and respect your legal advice.
Kind regards
D. Covezzi, A.Cury, N.Fabris, P. Rose,
Mr.Stafford and Mrs. Mocatta could not be contacted this evening before writing this email (Jewish Holidays), but they verbally agreed last week on this course of action.
